Terms of Service
These terms apply when you use codelabs88.com, contact us through this site, or pay a CodeLabs88 invoice online. If we have signed a separate agreement for your project, that agreement governs the work itself.

Agreement to these terms
This website is operated by CodeLabs88, LLC (“CodeLabs88,” “we,” “us”), a web development agency in Albuquerque, New Mexico. By using this site, submitting the contact form, or paying an invoice through a link we sent you, you agree to these terms. If you do not agree, please do not use the site.
What we do
We design, build, and maintain custom websites, e-commerce stores, and web applications, and we provide related services including SEO work, advertising management, hosting and deployment, and ongoing maintenance and support.
Descriptions of services, technologies, timelines, and pricing on this website are informational. They are not an offer, a quote, or a commitment to any particular scope, schedule, or price. A binding engagement starts only when we both sign a proposal or contract.
Signed agreements control your project
If you are a client, the proposal, statement of work, or services agreement you signed governs your project — scope, deliverables, fees, terms, cancellation, ownership of code and domains, and everything else specific to the work. Where anything in that signed agreement conflicts with anything on this page, the signed agreement controls for that engagement. These terms fill the gaps and govern your use of this website.
Invoices and payments
Invoices are emailed to you with a private link to a payment page. That link is the only credential needed to view and pay the invoice, so treat it like a password and do not forward it to anyone who should not see your billing details.
- How you can pay. Online by card through a Stripe-hosted checkout page, or by check, or — where we have set it up for you and you have opted in — by autopay from a bank account or a saved card. We never handle or store your card number or bank credentials; those go directly to Stripe.
- Card processing fee. Card payments include a separately itemized card processing fee that equals our actual cost of accepting the card (2.9% of the total charge plus $0.30, with gross receipts tax applied to the fee). On the checkout page it is shown as its own line before you pay; for card autopay it is disclosed when you enroll and itemized on each payment notice. Paying by check or bank draft avoids it entirely.
- Tax. New Mexico gross receipts tax is added where it applies and is stated separately on the invoice (currently 7.625%).
- Due dates and overdue balances. The due date is printed on each invoice. Invoices that go past due may accrue late charges or interest and may lead us to pause work or withhold deliverables, on the terms set out in your signed agreement and on the invoice itself.
- Autopay (bank auto-draft or saved card). Enrollment happens on a Stripe-hosted page and is entirely optional. Each invoice is charged to your enrolled method when it is issued, and you receive an email notice and a receipt. Bank debits take several business days to settle; card charges post right away. You can cancel enrollment at any time by contacting us, and we will confirm in writing.
Refunds and billing disputes
- Fees for work already performed are generally non-refundable. Deposits fund work that begins as soon as the deposit is received.
- Where a refund is owed under your signed agreement or agreed by us, we issue it through Stripe back to the original payment method. Bank and card networks generally take several business days to post it.
- If you believe an invoice is wrong, tell us within 30 days of the invoice date and we will review it with you and correct anything that is genuinely wrong. Please contact us before disputing a charge with your bank or card issuer — a chargeback freezes the funds and slows the fix down for both of us.
- Third-party costs we pass through at cost (hosting, domains, ad spend, licenses, API usage) are not refundable once incurred with the vendor.
Acceptable use of this website
You agree not to:
- submit false, automated, or bulk entries through the contact form, or use it to send unsolicited commercial messages;
- attempt to gain unauthorized access to the site, our admin area, the client portal, or any invoice, proposal, or contract link that was not sent to you;
- scrape, crawl, or load the site in a way designed to degrade it, evade rate limits, or interfere with other visitors;
- copy our page code, copy, or design system for resale, or reverse engineer any part of the site.
We rate-limit form submissions and log the IP addresses of submissions to enforce this. We may block access from any address that abuses the site.
Intellectual property
The design, code, copy, graphics, and arrangement of this website are owned by CodeLabs88 or used with permission. Client names, logos, screenshots, and live previews shown in our portfolio remain the property of those clients and are shown as examples of our work. Nothing here grants you a license to reuse any of it without our written permission.
Ownership of the code and deliverables we build for a client is governed by that client’s signed agreement, not by this page.
Third-party links and embedded previews
Our home and Our Work pages embed live previews of websites we have built, and we link out to those sites. Those are independent websites operated by our clients or other parties. We do not control their content, availability, security, or privacy practices, and we are not responsible for them. The same applies to any other third-party service linked from this site.
No warranty
This website is provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, to the maximum extent permitted by law.
We do not warrant that the site will be uninterrupted, timely, secure, or error-free, that any defect will be corrected, or that the site is free of harmful components. Information on this site, including anything about services, technologies, results, or timelines, is provided for general information and may change without notice.
We do not guarantee search rankings, traffic, leads, conversions, or revenue. Search engines, advertising platforms, and the market are outside our control.
Limitation of liability
To the maximum extent permitted by New Mexico law, CodeLabs88 and its owners and personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of this website — even if we have been advised that such damages are possible.
Our total aggregate liability for all claims arising out of or related to your use of this website is limited to one hundred U.S. dollars ($100).
This section is about your use of this website. It does not limit, replace, or override the liability, warranty, or remedy terms of a signed services agreement, which control for that engagement. Nothing in these terms excludes liability that cannot be excluded under applicable law.
Indemnity
You agree to indemnify and hold CodeLabs88 harmless from any claim, loss, or expense (including reasonable attorneys’ fees) arising from your misuse of this website, your violation of these terms, or your violation of the rights of any third party.
Governing law and venue
These terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws principles. Any legal action arising out of or related to these terms or your use of this website shall be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to personal jurisdiction in those courts.
Changes to these terms
We may update these terms. The effective date at the top of this page tells you when the current version took effect, and continuing to use the site after that date means you accept the updated terms.
